ParHosting Terms of Service
Introduction
This Terms of Service document is an agreement between ParHosting and the Customer, and therefore applies to any account(s) a customer may have with ParHosting. Be sure to read this document IN FULL and retain it for future reference. When accepting these Terms of Service, the customer agrees to periodically check the ParHosting website for any updates that may occur to this document. Note that the information contained in this document is subject to change without notice.
General Provisions
When using any services that are provided by ParHosting, the customer agrees to abide by the following terms and conditions.
Refering Definitions
When refering, in any documents or letters, "We", "Us", "Provider", "pH", or "ParHosting" refers to the ParHosting company. Any reference to "You", "Client", "Customer", or "Acceptee" refers to the person or people who is using the services provided by ParHosting.
Services Provided by ParHosting
ParHosting will rent out server space to the customer to be used as either as providing internet content to the internet community, or as an e-mail service to be used in communicating between others in the internet community. These services allow the Customers of ParHosting to be able to maintain internet websites, maintain and use e-mail accounts, and access web space via FTP and Browser interfaces. These services must be used in a manner that complies with any State and Federal laws. ParHosting will not in any way make an effort to edit, control, monitor, or restrict any content on the other than to make sure the content is within the acceptable State and Federal laws, as well as the standards of ParHosting. If any activities listed below are committed, ParHosting may immediately, and possibly without notice, terminate or suspend the Customers account(s). ParHosting will be the sole Arbiter as to what content constitutes a violation of the terms and conditions in this document.
Customer Use of Services
Disk Space and Client Content: ParHosting offers 250/500 MB (paid accounts, depending on selected plan). Accounts are to be used by the primary owner only, in that no reselling/lending/leasing is permitted. Account holders are not permitted to resell web-hosting services of their website to other parties. The Client agrees that webpages and files uploaded to our servers will not violate any state, federal or foreign laws or regulations; infringe on any intellectual property rights of ParHosting or any third party; be defamatory, slanderous or trade libelous; be threatening or harassing; be discriminatory based on gender, race, age; promote hate; or contain viruses or other computer programming defects which result in damage to ParHosting or any third party. Customers may not run IRC clients. Unacceptable uses of our service also include: Bulk emailing, unsolicited emailings, newsgroup spamming, pornographic content or links to adult websites, nudity, copyrighted MP3s, illegal content, copyright infringement, trademark infringement, warez, cracks, ROMS, Emulators, or software serial numbers. Content in websites using our Free services must abide by the following in addition to the previously stated items: accounts inactive for the first month will be terminated without warning, Personal sites are not acceptable usage of our resources, and the main section and entering page of the site must be in english (there may be multiple additional languages to the main site). ParHosting will be the sole and final arbiter as to what constitutes a violation of this policy.
Bandwidth Usage: ParHosting offers 2/5 GB (paid accounts, depending on plan selected) of data transfer within a 1 month period. Sites that use more than their limit will be suspended or possibly terminated. Not including the first month of existance, Clients using the Free Services provided by ParHosting must meet or exceed a bandwidth usage of 5 Megabytes each month or the account will be suspended or terminated. The Customer must contact our support department (support@parhosting.com) to have their service re-enabled.
Excessive Resource User Policy: Resources are defined as bandwidth and/or processor utilization. A website is considered to be using "Excessive amounts of resources" when it monopolizes the resources available. There are numerous activities that could cause such problems; these include: CGI scripts, PHP, FTP, HTTP, etc. This policy is only implemented in extreme circumstances and is intended to prevent the misuse of our servers. We reserve the rights to suspend or terminate any hosting account that we feel is jeopardizing our network. ParHosting will be the sole and final arbiter as to what constitutes a violation of this policy.
MySQL: ParHosting offers 25 MySQL databases for Xeon, and there is no limit to the number used in the Opteron Paid Plan.
No "Spam": UCE/UBE or "Spam" originating from a ParHosting account, or associated with a ParHosting account, is not tolerated. This includes any e-mail that promotes web sites hosted on a ParHosting account but is sent from an e-mail address not associated with that ParHosting account. The Client shall not use their ParHosting services for chain letters, junk mail, bulk-email, or any use of distribution lists to any person who has not given specific permission to be included in such a process. ParHosting reserves the right to suspend and/or terminate any account(s) upon any indication of such activity without notice.
Licensed Software Only: The Client agrees to use only properly licensed third party software in connection with Client's use of the Services.
Back-Up Files: ParHosting will make every reasonable effort to protect and backup data for the Client if needed, however ParHosting does not guarantee the existence, accuracy, or regularity of its backup services and, therefore, the client is solely responsible for independent backup of data stored on the Providers server and network.
Uptime: ParHosting has a 99% average uptime, meaning that you dont have to worry about your website being unavailable due to technical problems. If this were to occur, then we guarentee that ParHosting will do it's best to get everything back to full throttle.
